New Hampshire Superior Court Dismisses Lawsuit Against College

Here is a link to the Court's order and opinion granting summary judgment to the College in Brooks v. Dartmouth.

  • It's good that the lawsuit was dismissed, because lawsuits are bad for the college, but we have to be sure that elected Trustees reflect the interests of the alumni and students and faculty.

  • Lawsuits are unfortunate, but not always bad. Were the lawsuits by parents of injured students bad? Was the lawsuit of suspended Review students, in which they prevailed and were reinstated, bad? Are lawsuits initiated by the College bad?

    We have a legal system to resolve disputes for a reason.

  • Trustees should not be elected on the basis of how they "reflect the interests of the alumni and students and faculty". They should be elected on the the basis of how alumni think they will act in the best interests of the College. What the best interests of the College are is something alumni should be able to disagree on and debate.

  • I've been thinking a great deal lately about Joe Asch and I ask myself doe he really understand the role of a college trustee? Not just at Dartmouth but at any college or university? It's my understand that while trustees may have conflicting opinions on a subject that once a vote has been taken, the board unites behind that decision for the good the college. Will Joe be able to keep from use dartblog,com to vent his frustrations?

  • OK Executive Committee:

    Maybe John M is busy. Maybe my stream of messages has become a broken record to your ears.

    But you do ALL ALUMNI a dis-service. Why no AoA announcement post that there is a petition candidate certified in the trustee election? Why no opportunity for them to see my response to Hutchinson's comments regarding the ballot committee conflicts and constitutional change? Why no information to AoA members on why their blog (not yours!) is now being moderated?

    Jeesh... under the past administration, we even put up entirely new threads at the request of individual alumni members. You'uns apparently can't or won't even permit reply posts.

    Here's another suggestion... with the D now allowing on-line comments, why not just shut down the blog entirely. Its purpose of alumni dialog has been superceded; the students have done one better.

  • We alumni have an upcoming election for trustees. One seat is being contested between two candidates.

    When will our Association inform our members about this, and encourage discussion among alumni on these pages? Selecting trustees is our most important obligation to Dartmouth.

    If you believe that such discussion is served by the on-line D, then what is the purpose of this alumni-run blog?

  • Michael Chu writing in the D: “Like in any trustee election, those who love Dartmouth can choose to go to the polls and decide which type of owners should run the estate: those who believe the future of a jewel born in 1769 is best assured by mobilizing the collective wisdom of the family or those who come already armed with what is best for the family.”

    Agreed! Will the Executive Committee please provide equal treatment for trustee candidates nominated by alumni petition? Will it please explain why it is best for the family that comments are no longer posted here? Or does it intend to maintain its silence until after the election is over?
